EXECUTIVE SESSION.

Section 551.071 of the Texas Open Meetings Act to meet with its attorney to seek legal advice on a matter in which the duty of the attorney to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act relating to:

  1. Annexation Proceedings

Reconvene in Open Session to Consider and Take Action, if any, on any item discussed in Executive Session.

CITY MANAGER.

3.I.

Consider, discuss and take action on whether to approve Resolution No. 2019-901 to scheduled a 4th and 5th public hearing to hear comments for or against on whether the City should annex an area of land known as City's Proposed Phase 2 Annexation consisting of up to 1,400 acres of land located north of Aransas Pass and extending up to the City of Rockport's extraterritorial jurisdiction, and along Highway 35 Bypass and Highway 35 Business.

Development Agreement In Lieu of Annexation

Consider, discuss and take action to approve a Development Agreement in lieu of annexation for said property to remain agricultural, wildlife management, or timber ad valorem tax exemption.  Said property known as San Patricio County Appraisal District Property ID Nos. 1031243 and 1033948 owned by Daniel T. and Brenda H. Durand bearing a legal description of: 

  1. PART ABSTRACT 54 WILLIAM BOYD SURVEY and ABSTRACT 261 ELIZABETH TALLY SURVEY CONSISTING OF 112.210 ACRES; and
  2. PART ABSTRACT 261 ELIZABETH TALLY SURVEY CONSISTING OF 72.751 ACRES

Adoption of Phase III Annexation located on the: 1) west side of the City of Aransas Pass' extraterritorial jurisdiction, on the north side of Highway 35 and between the cities of Aransas Pass and Gregory; and 2) south of W. Wheeler Avenue between FM 1069 and the west side of the City of Aransas Pass' extraterritorial jurisdiction

Consider, discuss and take action to adopt Ordinance No. 2019-4246 to annex for full purposes up to 600 acres of land into the territorial limits of the City of Aransas Pass and extending the boundary limits of said city to include said hereinafter described property within said city limits:  and granting to all the inhabitants of the property all the rights and privileges of other citizens and binding the inhabitants by all of the Ordinances, Resolutions, Acts and Regulations of the City; adopting a Service Plan; finding and determining that all requirements for annexation include public hearings; notices and open meetings have been met according to law; providing instructions for filing this Ordinance and for correcting the Official Map and boundaries of said City; providing severability and cumulative clauses; and providing an effective date.
