All of the following items on the Consent Agenda are considered to be routine by the City Council and will be enacted with one motion. There will be no separate discussion of these items unless a Council member so requests. If discussion is desired, that item will be removed from the Consent Agenda and will be considered separately.

PUBLIC HEARINGS.

6.I.

Public hearing on Plat No. 0708-01, Tressa Walls for the replat of six 25-feet wide lots into three fifty 50-feet lots. Property is located at the southeast corner of North Rife and W. Lenoir Avenue (Legal Description: Lots 1, 2, 3, 4, 5, and 6, and 20 feet of Rife Street and 10 feet of Lenoir Avenue adjacent to 1, Block 476, Aransas Pass Townsite, Aransas County, Texas).

Public hearing on granting a Conditional Use Permit for one-year to Lucia and Juan Ramirez to bring their home on 820 No. Rife into building and zoning compliance. Legal Description: Lots 10 and 11, and 20 feet of Rife Street, Block 456, Aransas Pass, Aransas County, Texas).

Consider and Act on Ordinance No. 2019-4248 on granting a Conditional Use Permit for one-year to Lucia and Juan Ramirez to bring their home on 820 No. Rife into building and zoning compliance. Public Hearing - Voluntary Annexation

Hear voluntary petition to annex and conduct a public hearing for the proposed voluntary annexation of certain property commonly known as 520 Jacoby Lane, Aransas Pass, Texas 78336, Aransas County Property ID No. 14318, being a legal description of Lot No. Thirty-Three (33), Block No. Two Hundred Sixteen (216), Burton and Danforth Subdivision, Aransas County, Texas according to the Plat thereof recorded in Volume 1, Pages 62-63.

Resolution No. 2019-903 – Granting Petition to Voluntarily Annex

Consider, discuss and take action to approve Resolution No. 2019-903 hearing and granting a voluntary annexation petition from Chad Fake and Monique Fake, the property owners of an area of land commonly known as 520 Jacoby Lane, Aransas Pass, Texas 78336, Aransas County Property ID No. 14318, being a legal description of Lot No. Thirty-Three (33), Block No. Two Hundred Sixteen (216), Burton and Danforth Subdivision, Aransas County, Texas according to the Plat thereof recorded in Volume 1, Pages 62-63.

Ordinance No. 2019-4249 - Adoption of 520 Jacoby Lane Voluntary Annexation

Consider, discuss and take action to adopt Ordinance No. 2019-4249 to voluntarily annex certain property commonly known as 520 Jacoby Lane, Aransas Pass, Texas 78336, Aransas County Property ID No. 14318, being a legal description of Lot No. Thirty-Three (33), Block No. Two Hundred Sixteen (216), Burton and Danforth Subdivision, Aransas County, Texas according to the Plat thereof recorded in Volume 1, Pages 62-63; And extending the boundary limits of the City so as to include the described property within the City limits, and granting all inhabitants of the property all the rights and privileges of other citizens and binding the inhabitants by all of the Ordinances, Resolutions, Acts, and Regulations of the City’ Adopting a Municipal Service Plan for the property: Providing instructions for filing the Ordinance and correcting the Official Map and boundaries of said City; Providing severability and cumulative clauses; and Providing an Effective Date.

CITY MANAGER.

7.I.

Consider and Act on accepting funds in the amount up to $85,677 from Rebuild Texas Fund for an HVAC system at the Aransas Pass Civic Center.

7.II.

Consider and Act on Resolution No. 2019-905 approving the City's Purchasing Policy.

7.III.

Consider, discuss and take action on Resolution to accept or deny each petition filed for inclusion into the Municipal Annexation Plan for petitioners who reside or own land in the proposed Phase 2 Annexation of property consisting of up to 1,400 acres of land located North of Aransas Pass and extending up to the City of Rockport's extraterritorial jurisdiction, and along Highway 35 Bypass and Highway 35 Business.

7.IV.

Consider and Act on Resolution No. 2019-904 of the City Council of the City of Aransas Pass, Texas authorizing the submission of a Community Development Block Grant Disaster Recovery (CDBG-DR) application to the Texas General Land Office and authorizing the Mayor to act as the Town's Executive Officer and authorized representative in all matters pertaining to the Town's participation in the CDBG-DR Program.

7.V.

Consider and Act on adopting Procurement Policies and Procedures for the City of Aransas Pass.

COMMUNITY ENRICHMENT.

Community Enrichment includes the following: Civic Center, Aquatic Facility, Library, and Senior Center.

DEVELOPMENT SERVICES.

Development Services includes the following: Building Services, Parks, Planning, Public Works, and Maintenance.
9.I.

Consider and Act on extending the Facility Lease Agreement between the City of Aransas Pass and Aransas Pass Little League beginning August 1, 2019 through December 31, 2019, and automatically renew January 1, 2020 fro twelve months expiring December 31, 2020.

9.II.

Consider and Act on Ordinance No. 2019-4250 amending the City Code of Ordinances by revising Building Permit Fees, Mechanical Permit Fees, Electrical Permit Fees, Plumbing Permit Fees, and Irrigation Permit Fees; provide a repealing and severability clause; provide for publication; provide an effective date; and ordaining other related matters.

FINANCE.

Finance includes the following: Utility Billing, Finance, Human Resources, and Meter Reading.

Consider and Act on Ordinance No. 2019-4247 amending the City Code of Ordinances, Chapter 29, by adding Section 29-27(c), Option for Irrigation Metering; and, providing for an effective date.

Section 551.087 Deliberations regarding Economic Development Negotiations related to Potential Housing.

15.II.

Section 551.071 of the Texas Open Meetings Act to meet with its attorney to seek legal advice on a matter in which the duty of the attorney to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act relating to:

PUBLIC NOTICE is hereby given that the City Council may elect to go into executive session at any time during the meeting in order to discuss any matters listed on the agenda, when authorized by the following provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code:

  1. Section 551.071, Contemplated or pending litigation or matters where legal advice is requested of the City Attorney.
  2. Section 551.072, The purchase, exchange, lease or value or real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
