HB 2840 approved by the 86th Legislature states that governmental bodies shall allow each member of the public who desires to address the body regarding an item on an agenda, may do so either before or during consideration of the item.  Citizens who wish to speak on an agenda item, will have an opportunity to address the body before the item is discussed, and will be given a three (3) minute time limit to make their comments.

All of the following items on the Consent Agenda are considered to be routine by the City Council and will be enacted with one motion. Consider and Act on approving Resolution 2019-922 adopting the Aransas Pass Crime Control & Prevention District Budget for FY 2019-2020.

Consider and Act on the issuance of a Request for Proposals for repairs to the Civic Center Audio Visual System and Electrical.

Consider and Act on approving Task Order 14 with LNV, Inc. for HVAC, Electrical and Audio/Video repairs at the Aransas Pass Civic Center in the amount of $39,500.

7.IV.

Presentation, discussion and action, if any, approving a Resolution to extend the period to provide "Full Municipal Services" to Sherwood Forest, an area of land annexed pursuant to City Ordinance 2016-4136 for no later than 4½ years after effective date of annexation due to damage caused by Hurricane Harvey, which was beyond the direct control of the City.

Consider and Act on approving Resolution No. 2019-924 establishing a City Council Administrative Committee.

Consider and Act on approving Resolution No. 2019-925 designating a Council Member Liaison on the Planning and Zoning Commission.

Citizen comments are intended for matters that are not scheduled on the agenda.  Please limit your comments to three minutes and state your name and address for the record.  Be advised that the Texas Open Meetings Act prohibits the City Council from responding and discussing your comments.  The law authorizes the following:
  • Make a statement of factual information,
  • Recite existing policy,
  • Advise that this subject may be placed on the agenda for a subsequent meeting.

EXECUTIVE SESSION.

15.I.

Section 551.071 of the Texas Open Meeting Act to meet with its Attorney to seek legal advice on a matter in which the duty of the Attorney to the City Council under the Texas Disciplinary Rules of Professional conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act relating to:

  1. City of Aransas Pass vs. J.M. Davidson, Ltd., RLI Insurance Company, and Naismith Engineering, Cause No. S-14-6278-CV-C in the 343rd Judicial District Court in San Patricio County, Texas.
  2. Association Against Annexation Abuse vs.City of Aransas Pass, Cause No. A-19-0169-CV-B in the 156th District Court of Aransas County,Texas.  Said Association against Annexation Abuse legally represented by David L. Earl, Attorney, who also legally represents Rockport Terminals, LLC.
  3. Update on HB 2840
  4. Water Rate Study
  5. Building Permits and Other City Issued Permits
  6. Environmental Issues

Reconvene in Open Session to Consider and Take Action, if any, on any item discussed in Executive Session.

PUBLIC NOTICE is hereby given that the City Council may elect to go into executive session at any time during the meeting in order to discuss any matters listed on the agenda, when authorized by the following provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code:

  1. Section 551.071, Contemplated or pending litigation or matters where legal advice is requested of the City Attorney.
  2. Section 551.072, The purchase, exchange, lease or value or real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
  3. Section 551.073, A contract for a prospective gift or donation to the city, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
